Rules on disabled use on public transport

Clarification has been sought from the appeal court after a women refused to move a pushchair from a bay causing a disabled person to leave the vehicle.

In September a County Court Judge ruled that First’s policy was  in breach of the Equality Act 2010 however this has since been overturned in First’s favour.

A grey area within the Disability Discrimination Act. Although the Act suggests that wheelchair users have priority over buggy users this is on the basis that there a sufficient space for the buggy to be folded and the child to be able to sit with an adult elsewhere.

The Act also give the driver the right to ask people to move from the wheelchair space but does allow the driver the power to compel people to move.

Hopefully this case will lead to a further look into the Act and a clearer policy can be put in place.
