Local authority stops paying elderly lady's care home fees

The Local Government and Social Care Ombudsman has found that a local authority had wrongly stopped paying for an elderly lady’s care home placement after deciding that she had spent her money to avoid having to pay care home fees – the local authority believed there had been a deprivation of assets.

As a result, the local authority in question will need to complete a backdated financial assessment and repay any money that results from this.

This decision highlights the need to ensure local authority’s are carrying out financial assessments correctly. Whilst this can be difficult, there is guidance in place to assist local authority’s with this.
